§1. General Provisions

These terms of service govern the use of the FitPlanAI application. By using the app, you accept these terms.

§3. Definitions

  • App – the FitPlanAI progressive web application (PWA) available at fitplanai.app
  • User – a natural person using the App
  • Consumer – a natural person making a purchase not directly related to their business or professional activity
  • Account – an individual User account in the App
  • Premium – a paid access plan with additional features

§4. Technical Requirements

Using the App requires a web browser with JavaScript support (Chrome, Firefox, Safari, Edge in the current version) and an active internet connection. The App works on iOS, Android devices, and desktop computers. The App supports offline mode – you can run workouts without an internet connection, and data syncs automatically when the connection is restored.

§5. Service Description

FitPlanAI is a strength training management app that allows you to:

  • • create and manage workout plans
  • • run training sessions with timers and set counters
  • • track progress and training history
  • • record body measurements
  • • generate AI-powered workout plans
  • • browse exercise database with descriptions and video instructions
  • • create custom exercises
  • • export data to JSON/CSV

§6. User Account

  • • You must be at least 16 years old to use the App. Persons under 16 may use the App with the consent of a parent or legal guardian.
  • • Registration requires providing an email address and creating a password or signing in with Google.
  • • You are responsible for maintaining the confidentiality of your password and securing your account.
  • • You agree to provide accurate information during registration.
  • • Each User may only have one account.

§7. Pricing Model (Freemium)

The app offers two plans:

Free Plan

  • • 1 workout plan (4 weeks with weekly modules)
  • • Training history from the last 30 days
  • • Basic measurements only (weight)
  • • 1 AI plan

Premium Plan

  • • Unlimited workout plans
  • • Full training history
  • • All body measurements (circumferences, body fat)
  • • Advanced statistics and charts
  • • Export data to JSON/CSV
  • • Up to 3 AI plans

§8. Payments

  • • Payments are processed by PayU. We accept BLIK and credit cards.
  • • Premium access payments are one-time purchases. After the selected period (month/year) ends, access expires automatically – we do not charge any fees without your knowledge.
  • • Premium features will remain active until the end of the paid period.
  • • We will notify you of price changes 30 days in advance.

§9. Order Fulfillment

  • • FitPlanAI is a digital service (digital content) within the meaning of consumer rights law.
  • • Access to Premium features is activated immediately after payment is processed.
  • • Purchase confirmation with invoice will be sent to the email address provided during registration.
  • • Access to purchased features is available immediately after logging into the App.

§10. Right of Withdrawal

  • • In accordance with Article 16(m) of the Consumer Rights Directive, the right to withdraw from a distance contract does not apply to the Consumer in relation to contracts for the supply of digital content not supplied on a tangible medium, for which the Consumer is obliged to pay a price, if the trader has begun performance with the Consumer's prior express consent, and the Consumer was informed before the commencement of performance that they would lose the right of withdrawal, and acknowledged this.
  • • By purchasing the Premium plan, the User consents to the immediate provision of the service and acknowledges the loss of the right of withdrawal.
  • 7-day satisfaction guarantee: Nevertheless, we offer a voluntary satisfaction guarantee. If within 3 days of purchase you find that the service does not meet your expectations, contact us at kontakt@fitplanai.app – we will refund the full amount.
  • • Refunds are made using the same payment method used by the Consumer, no later than 7 days from the date of receiving the request.

§11. Complaints

If you have concerns about the service or payment, you can file a complaint:

A complaint should include: name, account email address, description of the issue, and expected resolution.

We process complaints within 14 days from the date of receipt.

§12. Out-of-Court Dispute Resolution

  • • The Consumer has the option to use out-of-court methods of handling complaints and pursuing claims.
  • • Detailed information on the Consumer's options for using out-of-court methods of handling complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and the Office of Competition and Consumer Protection.

§13. User Content

  • • You retain full rights to your workout data, measurements, and custom exercises.
  • • You grant us a non-exclusive license to store and process your data solely for the purpose of providing the service.
  • • You can export your data or delete your account at any time.

§14. Prohibited Activities

The following is prohibited:

  • • using the App for purposes inconsistent with its intended use
  • • attempts to hack, reverse engineer, or bypass security measures
  • • using the App for illegal activities
  • • sharing your account with others
  • • using bots or automated scripts
  • • intentionally overloading the App's servers

§15. Limitation of Liability

  • • The App is provided 'as is'. We make every effort to ensure its proper operation.
  • • We notify you of planned maintenance at least 24 hours in advance via the App or email.
  • • In case of service unavailability lasting longer than 24 hours due to reasons on our side, the Premium subscription period will be extended by the duration of the unavailability.
  • • We are not responsible for data loss caused by external factors or force majeure.
  • • We do not guarantee specific training results.

The App does not constitute medical or dietary advice. Consult a doctor before starting a training program.

§16. Termination and Account Deletion

  • • You can delete your account at any time in the App settings.
  • • Before deleting your account, we recommend exporting your data (feature available in settings).
  • • We reserve the right to suspend or delete accounts that violate these terms, after prior notice to cease violations.
  • • After account deletion, your data will be permanently deleted.

§17. Changes to Terms

  • • We may update these terms in case of legal, technical, or business changes.
  • • We will notify you of significant changes by email or in the App with 14 days notice.
  • • Continued use of the App after changes take effect constitutes acceptance of the new terms.
  • • If you do not accept the changes, you may delete your account before the changes take effect.

§18. Governing Law and Dispute Resolution

  • • These terms are governed by Polish law.
  • • Disputes with Consumers will be resolved by the court having jurisdiction in accordance with the provisions of the Code of Civil Procedure.
  • • The provisions of these terms do not exclude or limit Consumer rights under mandatory provisions of law.
